Five Years of War: A Call for Peace, Justice, and Accountability in Myanmar

Although much of the world has expressed excitement over Myanmar’s political transition, communities throughout Kachin and northern Shan states have been living with severe human rights abuses and displacement for the last five years.

Since 2011, renewed armed conflict between the Myanmar military and the Kachin Independence Army (KIA) has displaced more than 100,000 civilians. In the conduct of the war, the Myanmar military has perpetrated severe human rights violations. International and community-based organizations have documented extrajudicial killings, torture, forced labor, rape and sexual violence, arbitrary detention, attacks on civilians and non-military targets, and pillaging of property. These abuses have been perpetrated with near-complete impunity. Some of the abuses may amount to war crimes and crimes against humanity under international law.

Forced into dozens of displacement camps, entire communities have lost their homes, livelihoods, and belongings. Displaced populations continue to face avoidable deprivations in humanitarian aid. The Myanmar government and military have denied humanitarian organizations unfettered access to displaced populations, and funding for Kachin-led aid groups has been insufficient to meet the needs of displaced communities. Unnecessarily delaying travel authorizations to the displacement camps in government controlled areas and entirely restricting access to KIA-controlled areas for humanitarian actors has led to severe consequences for people in need of support.

Displaced families lack adequate food, healthcare, education, water and sanitation, and shelter. Some displaced families now eat one meal per day due to irregular delivery of food rations. Preventable illnesses have resulted in needless death. The dearth of funding for schools and teachers is depriving children of adequate education, stunting the development of an entire generation. As the rainy season approaches once again, war-affected displaced populations are still struggling to live in unsafe conditions in which they have no protection against wind and rain. Today, there is no meaningful prospect for displaced communities to return home safely or rebuild their lives with dignity.

June 9, 2016 marks the five-year anniversary of the resumption of armed conflict in Kachin State—a date that ended a 17-year-long ceasefire. The Nationwide Ceasefire Agreement (NCA) negotiated under former President Thein Sein failed to end the war, and the prospects for an inclusive peace agreement remain distant.

Today, we the undersigned organizations call for peace, justice, and accountability in Kachin State.

First and foremost, we request that the Myanmar military immediately end all offensives in Kachin and northern Shan states, and we urge President Htin Kyaw and State Counselor Aung San Suu Kyi to immediately authorize universal and unfettered access for humanitarian groups to all affected areas. The military and authorities should provide safe, sustained, and unhindered access to all areas of affected populations to allow humanitarian organizations to give necessary help and support.

Ongoing and unchecked human rights violations only hinder efforts to achieve a lasting peace in Kachin and northern Shan states. The government and military should end the endemic culture of impunity once and for all. Perpetrators of human rights violations should be held accountable for their crimes in independent and impartial courts of law, regardless of rank or position. Likewise, survivors of human rights violations should receive prompt and adequate compensation for harms suffered.

To ensure the future promotion and protection of human rights, the government should ratify without delay key human rights treaties, including the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment as well as the Rome Statute of the International Criminal Court.

The government should ensure an inclusive peace process that involves all actors and prioritizes human rights. Furthermore, it is vital for the achievement of a sustainable peace that women play an active role in this peace process.

Today, we express our solidarity with the suffering and struggle of communities and families throughout the war-affected areas and we do so in the spirit of peace, justice, and accountability, which we believe go hand in hand. We call upon the government and military to end the war in Kachin State.

ငါးႏွစ္ျပည့္ေျမာက္ခဲ့ျပီျဖစ္ေသာ ကခ်င္ေဒသတေက်ာ့ျပန္စစ္ပြဲႏွင့္ ျမန္မာႏိုင္ငံ ျငိမ္းခ်မ္းေရး၊ တရားမွ်တမႈႏွင့္ တာဝန္ယူမႈ/တာဝန္ခံမႈ တုုိ႔အတြက္ ေတာင္းဆိုခ်က္။

၂၀၁၁ ခုႏွစ္တြင္ တစ္ဖန္ျပန္လည္စတင္ခဲ့ေသာ ျမန္မာ့တပ္မေတာ္ ႏွင့္ ကခ်င္လြတ္ေျမာက္ေရး တပ္္မေတာ္ (KIA) တုုိ႔အၾကားလက္နက္ကိုင္တိုက္ပြဲမ်ားေၾကာင့္ ျပည္သူေပါင္းတစ္သိန္းေက်ာ္ အိုးမဲ့အိမ္မဲ့ျဖစ္ခဲ့ရျပီး   စစ္ပြဲကာလအတြင္းတြင္   အျပစ္မဲ့ျပည္သူမ်ားမွာ   ျပင္းထန္ေသာ   လူ႔အခြင့္အေရးခ်ိဳးေဖာက္မႈမ်ားစြာကို ခံစားခဲ့ရသည္။ဥပေဒမဲ့သတ္ျဖတ္ျခင္း၊ ညွင္းပမ္းႏွိပ္စက္ျခင္း၊ အဓမၼခုုိင္းေစျခင္း၊ မုုဒိမ္းက်င့္ျခင္း ႏွင့္ အျခားလိင္ပုုိင္းဆုုိင္ရာ အၾကမ္းဖက္မႈမ်ား က်ဴးလြန္ျခင္း၊ တစ္ဖက္သတ္စြပ္စြဲ၍ ဖမ္းဆီးထိန္းသိမ္းျခင္း၊ စစ္တပ္ႏွင့္ မသက္ဆုုိင္သည့္ေနရာမ်ားႏွင့္ အရပ္သားမ်ားအေပၚ ပစ္မွတ္ ထားတုုိက္ခုုိက္ျခင္း ႏွင့္ ျပည္သူ့အုုိးအိမ္၊ စည္းစိမ္မ်ားကုုိ ဖ်က္ဆီးျခင္းစသည့္ လူ႔အခြင့္အေရးခ်ိဳး ေဖာက္မႈမ်ား အေပၚ ျပစ္မႈက်ဴးလြန္ခဲ့သူမ်ားကုုိ ဥပေဒႏွင့္အညီျပစဒဏ္စီရင္ရျခင္း မရွိသေလာက္ နည္းပါးေနေၾကာင္း အျပည္ျပည္ဆုုိင္ရာ အဖြဲ႔အစည္းမ်ားႏွင့္ လူထုုအေျချပဳအဖြဲ႔အစည္းမ်ားမွမွတ္တမ္း တင္ထားသည္။

ထုုိလူ႔အခြင့္အေရးခ်ိဳးေဖာက္မႈမ်ားစြာထဲမွ အခ်ိဳ.မွာ ႏိုင္ငံတကာဥပေဒမ်ားအရ စစ္ရာဇဝတ္မႈေျမာက္ျပီး လူသားမ်ိဳးႏြယ္အေပၚက်ဴးလြန္သည့္ ရာဇဝတ္မႈမ်ားအျဖစ္ သတ္မွတ္၍ရေသာ ျပစ္မႈမ်ားျဖစ္သည္။ ေထာင္ေပါင္းမ်ားစြာေသာ စစ္ေဘးေရွာင္စခန္းမ်ားသုုိ႔ မျဖစ္မေနေျပာင္းေရႊ.ေနထိုင္ရသည့္အေျခအေနေၾကာင့္ လူမႈအသိုင္းအဝုုိင္းတစ္ခုလံုး၏  အိုးအိမ္၊  အသက္ေမြးဝမ္းေက်ာင္းႏွင့္  ပိုင္ဆိုင္မႈမ်ား အားလံုုးဆံုးရႈံးခဲ့ရသည္။ ေျပာင္းေရႊ့  ေနထိုင္ရသူမ်ားသည္ ခ်ိဳ.တဲ့ေသာလူသားခ်င္းစာနာေထာက္ထားမႈဆိုင္ရာအကူအညီမ်ား ျပတ္လပ္မေလာက္ငမႈမ်ားႏွင့္ ဆက္လက္ ရင္ဆိုင္ေနရသည္။

ေနရပ္စြန္႔ခြာေျပာင္းေရႊ႔ရေသာ  စစ္ေဘးသင့္ျပည္သူမ်ားအတြက္  လူသားခ်င္းစာနာေထာက္ထားမႈ  အကူအညီ မ်ား လက္လွမ္းမီွရရွိေအာင္ ေထာက္ပံ့ေဆာင္ရြက္ေပးေနသည့္ အဖြဲ႔အစည္းမ်ားမွာ ခြင့္ျပဳခ်က္၊ ခရီးသြားလာခြင့္ အကန္႔အသတ္မ်ားစြာျဖင့္ ရင္ဆုုိင္ေနရျပီး ကခ်င္မ်ားဦးစီးသည့္ ေထာက္ပံကူညီေရး အဖြဲ႔အစည္းမ်ားမွာလည္း စစ္ေဘးသင့္ျပည္သူမ်ား၏မ်ားျပားလွေသာ လုုိအပ္ခ်က္မ်ားကုုိ ျဖည့္ဆည္း ေထာက္ပံ့ေပးႏုုိင္ေလာက္ေသာ ရန္ပံုုေငြ မရွိေပ။ အထူးသျဖင့္ ကခ်င္လြတ္ေျမာက္ေရးတပ္မေတာ္ (KIA) ထိန္းခ်ဳပ္ရာေဒသမ်ားရွိ စစ္ေဘးေရွာင္စခန္းမ်ားသုိ႔ လူသားခ်င္းစာနာေထာက္ထားမႈအကူအညီမ်ား ေထာက္ပံ့ေပးႏုုိင္ရန္ အဖြဲ႔အစည္း မ်ားခရီးသြားလာခြင့္ကုုိ  တာဝန္ရွိသူမ်ားမွမလုုိလားအပ္ေသာ  ေႏွာင့္ေႏွးၾကန္႔ၾကာမႈမ်ားျဖင့္ ထိန္းခ်ဳပ္ထားရာ ေထာက္ပံ့ေရးအကူအညီမ်ား   ပုုိမုုိလုုိအပ္ေနသည့္ေနရာမ်ားသုုိ႔ လက္လွမ္းမွီေပးပုုိ႔ႏုုိင္မႈအေပၚဆုုိးဝါးသည့္အက်ိဳးဆက္မ်ားကုုိ ျဖစ္ေပၚေစသည္။

ေနရပ္စြန္႔ခြာေျပာင္းေရႊ.ရေသာမိသားစုမ်ားသည္ လံုေလာက္ေသာ အစာအာဟာရ၊ က်န္းမာေရးေစာင့္ေရွာက္မႈ၊ေသာက္သံုုးေရႏွင့္  အိမ္သာ၊  အမုုိးအကာ  မရွိေနထုုိင္ေနရျပီး  ယခုုအခါ  အခ်ိဳ.မိသားစုုမ်ားမွာ  စားနပ္ရိကၡာ ပံုုမွန္မရရွိေတာ့ေသာေၾကာင့္ တစ္ေန႔လွ်င္ ထမင္းတစ္နပ္သာ   စားေနၾကရပါသည္။ ကာကြယ္၍ရႏိုင္ေသာ ေရာဂါမ်ားပင္ျဖစ္ေသာ္လည္း က်န္းမာေရးေစာင့္ေရွာက္မႈ ခ်ိဳ.တဲ့ေသာေၾကာင့္ မလိုလားအပ္ပဲအသက္ဆုံးမႈမ်ားကုုိ ျဖစ္ေပၚေစသည္။

စာသင္ေက်ာင္းမ်ားႏွင့္ ဆရာ၊ဆရာမမ်ားအတြက္ ရန္ပံုေငြရွားပါးမႈေၾကာင့္ ကေလးမ်ား၏ ေက်ာင္းပညာေရး တြင္မ်ားစြာေႏွာင့္ေႏွး ထိခိုု္က္ေစျပီး မ်ိဳးဆက္တစ္ခုလံုး၏ဖြံ႕ျဖိဳးတိုးတက္ေရးကိုု အဟန္႔အတားျဖစ္ေစသည္။ မၾကာမီတြင္ မိုးရာသီက်ေရာက္ ေတာ့မည္ျဖစ္ေသာ္လည္း ေနရပ္စြန္႔ခြာေျပာင္းေရႊ.ရေသာ စစ္ေဘး သင့္ျပည္သူမ်ားမွာမူ ေလဒဏ္၊ မုုိးဒဏ္ကုုိ ေကာင္းစြာ အကာအကြယ္မေပးႏုုိင္ေသာ လံုုျခံဳမႈမရွိသည့္ အေျခအေနမ်ားတြင္ ဆက္လက္ၾကိဳးစားရုန္းကန္ကာ ေနထိုင္အသက္ ဆက္ေနၾကရသည္။ ယေန႔အခ်ိန္အထိေနရပ္စြန္႔ခြာေျပာင္းေရႊ.ေနထိုင္ရသူမ်ားအေနႏွင့္     မိမိတို႔     ရပ္ရြာ/ေနအိမ္မ်ားထံ     ေဘးအႏၲရာယ္ကင္းစြာျပန္ႏိုင္ရန္ သို႔မဟုတ္ ၎တို႔၏ ဘဝကို လူ႔ဂုဏ္သိကၡာႏွင့္အညီ ျပန္လည္တည္ေဆာက္ႏိုင္ရန္ ေမွ်ာ္လင့္ခ်က္ႏွင့္ျဖစ္ႏုုိင္ေျခမွာ မရွိသေလာက္ပင္ ျဖစ္ေနပါေသးသည္။

၂၀၁၆ ခုုႏွစ္၊ ဇြန္လ (၉) ရက္ေန႔တြင္ ကခ်င္ျပည္နယ္အတြင္း (၁၇) ႏွစ္ၾကာ အပစ္အခတ္ရပ္စဲမႈ အဆံုုးသတ္ျပီး လက္နက္ကုုိင္တုုိက္ပြဲမ်ား ျပန္လည္စတင္ခဲ့ျခင္း (၅) ႏွစ္ ႏွစ္ပတ္လည္ တစ္ဖန္ျပည့္ခဲ့ျပီ ျဖစ္ပါသည္။ ယခင္သမၼတေဟာင္းဦးသိန္းစိန္လက္ထက္တြင္ ညွိႏႈိင္းခ်ဳပ္ဆုုိခဲ့သည့္ တစ္ႏိုင္ငံလံုးဆိုင္ရာ အပစ္အခတ္ ရပ္စဲေရးသေဘာတူစာခ်ဳပ္ (NCA) သည္ ထိုစစ္ပြဲမ်ားကို္ ရပ္တန္႔ႏိုင္ျခင္းမရွိခဲ့သည္ သာမက အားလံုးပါဝင္ႏုုိင္ေသာ ျငိမ္းခ်မ္းေရး သေဘာတူညီမႈရရွိ ရန္ အလားအလာမရွိသေလာက္ ေဝးကြာေနပါသည္။

သုုိ႔ပါ၍ ဤသေဘာထားထုုတ္ျပန္ခ်က္၏ ေအာက္တြင္ လက္မွတ္ေရးထိုးပါဝင္ေသာ ကၽြႏ္ုပ္တို႔အဖြဲ႔အစည္းမ်ား အေနျဖင့္     ကခ်င္ျပည္နယ္အတြင္း     ျငိမ္းခ်မ္းေရး၊     တရားမွ်တမႈႏွင့္     တာဝန္ယူမႈ/တာဝန္ခံမႈရွိေစရန္ ေအာက္ေဖာ္ပါျပအတုုိင္း ေတာင္းဆိုသည္။
ပထမဦးစြာ ကခ်င္ျပည္နယ္ႏွင့္ ရွမ္းျပည္နယ္ျမာက္ပိုင္းတို႔တြင္ ထုုိးစစ္ဆင္ တုုိက္ခုုိက္ေနမႈမ်ားကို ခ်က္ခ်င္း ရပ္တန္႔ေပးရန္ ျမန္မာတပ္မေတာ္အား ကၽြႏုု္ပ္တုုိ႔မွ ေတာင္းဆုုိသည္။ လူသားခ်င္းစာနာေထာက္ထားမႈဆိုင္ရာ အကူ အညီမ်ားေထာက္ပံေပးေနေသာအဖြဲ႔အစည္းမ်ားအား စစ္ေဘးသင့္ေဒသမ်ားအားလံုးသို႔ ကန္႔သတ္ခ်က္မဲ့ သြားေရာက္      ကူညီေထာက္ပံ့ခြင့္အျပည္႔အဝေပးရန္      သမၼတဦးထင္ေက်ာ္ႏွင့္      ႏိုင္ငံေတာ္အတိုင္ပင္ခံ ေဒၚေအာင္ဆန္းစုၾကည္တို႔အား  တိုက္တြန္းသည္။  စစ္တပ္ႏွင့္  အာဏာပုုိင္မ်ားအေနျဖင့္ စစ္ေဘး သင့္ျပည္သူမ်ား ေနထိုင္ရာေဒသမ်ားသို႔ လုုိအပ္ေသာ အကူအညီအေထာက္အပံ့မ်ားေပးႏုုိင္ရန္ လူသားခ်င္း စာနာေထာက္ထားမႈဆုုိင္ရာ အကူအညီေပးေနေသာအဖြဲ႔အစည္းမ်ားကုုိ လံုျခံဳ၍ ေႏွာင့္ေႏွးၾကန္႔ၾကာမႈ မရွိေစဘဲေရရွည္သြားလာခြင့္ေပးရန္ တုုိက္တြန္းသည္။
စံုစမ္းစစ္ေဆးအေရးယူျခင္းမရွိေသာ လူ႔အခြင့္အေရး ခ်ိဳးေဖာက္မႈမ်ားကုုိ ဆက္လက္ျဖစ္ေပၚေနေစျခင္းသည္ ကခ်င္ျပည္နယ္ႏွင့္ ရွမ္းျပည္နယ္ေျမာက္ပိုင္းတြင္ ေရရွည္တည္တံ့ေသာ ျငိမ္းခ်မ္းေရးရရွိရန္ ႀကိဳးစားအားထုတ္ ေနမႈမ်ားကို ေႏွာင့္ေႏွးၾကန္႔ၾကာ ဆုုတ္ယုုတ္မႈမ်ားကုုိသာ ျဖစ္ေပၚေစသည္။

အစိုးရႏွင့္ တပ္မေတာ္အေနျဖင့္ ေနရာအႏွံ႔ျဖစ္ေပၚေနေသာ ျပစ္မႈက်ဴးလြန္သူမ်ားကုုိ ျပစ္ဒဏ္မွ ကင္းလြတ္္ခြင့္ေပးထားသည့္အစဥ္အလာကုုိ    အျပီးတုုိင္ခ်က္ခ်င္း    အဆံုးသတ္သင့္သည္။    လူ႔အခြင့္အေရး ခ်ိဳးေဖာက္မႈမ်ားက်ဴးလြန္သူမ်ားကို   လြတ္လပ္၍   ဘက္လုုိက္မႈကင္းေသာ   တရားရံုးမ်ားတြင္   မည္သုုိ႔ေသာ ရာထူးအဆင့္အတန္းရွိေစကာမူ ဥပေဒအတုုိင္း စစ္ေဆးအေရးယူျပီး ၄င္းတုုိ႔က်ဴးလြန္ခဲ့သည့္ ျပစ္မႈမ်ား အတြက္ တာဝန္ယူမႈ/တာဝန္ခံမႈ ရွိေစသင့္သည္။ ထုုိ႔အတူပင္ လူ႔အခြင့္အေရးခ်ိဳးေဖာက္ခံရသူမ်ားကို ၄င္းတုုိ႔၏ ဆံုးရႈံး နစ္နာခဲ့ရမႈမ်ားအတြက္ သင့္တင့္ေလ်ာက္ပတ္ေသာကုုစားမႈႏွင့္ နစ္နာေၾကးမ်ားကုုိ လ်င္ျမန္စြာ ရေစသင့္သည္။

အနာဂတ္တြင္  လူ႔အခြင့္အေရးကုုိ  ကာကြယ္ေစာင့္ေရွာက္ျမွင့္တင္ႏုုိင္မႈ  ေသခ်ာေစရန္  အစိုးရအေနျဖင့္ “ညွင္းပမ္း ႏွိပ္စက္ျခင္းႏွင့္ အျခားလူမဆန္ရက္စက္သည့္ လုုပ္ရပ္မ်ား၊ ခ်ိဳးႏွိမ္သိမ္ငယ္ေစေသာ ခြဲျခားဆက္ဆံမႈ (သို႔မဟုတ္) အျပစ္ ေပးမႈတုိ႔ိကုိ ဆန္႔က်င္ေသာ ႏုုိင္ငံတကာသေဘာတူစာခ်ဳပ္” ႏွင့္ “ေရာမသေဘာတူညီခ်က္ ႏိုင္ငံတကာ     ရာဇဝတ္မႈဆိုင္ရာ     တရားရံုး”     အပါအဝင္     အဓိကက်ေသာ     လူ႔အခြင့္အေရးဆိုင္ရာ ႏုုိင္ငံတကာသေဘာတူစာခ်ဳပ္မ်ားကို ေႏွာင့္ေႏွးၾကန္႔ၾကာမႈ မရွိဘဲ အတည္ျပဳ လက္မွတ္ေရးထိုးသင့္သည္။ အစိုးရအေနႏွင့္ လူတုုိင္းပါဝင္ေဆာင္ရြက္ခြင့္ရွိေသာ လူ႔အခြင့္အေရးကို ဦးစားေပးသည့္ အားလံုးပါဝင္ႏုုိင္မည့္ ျငိမ္းခ်မ္းေရးလုပ္ငန္းစဥ္အျဖစ္      ေသခ်ာေစရန္      ေဆာင္ရြက္သင့္သည္။      ထို႔ျပင္ေရရွည္တည္တံ့ေသာ ျငိမ္းခ်မ္းေရးကို ထိန္း သိမ္းႏိုင္ရန္ ထုုိျငိမ္းခ်မ္းေရးလုပ္ငန္းစဥ္ထဲတြင္ အမ်ိဳးသမီးမ်ားကို ပါဝင္ေဆာင္ရြက္ ခြင့္ျပဳရန္လည္း အေရးၾကီးသည္။

ကၽြႏု္ပ္တို႔သည္ စစ္ေဘးသင့္ေဒသမ်ားရွိ လူမႈအသိုင္းအဝုုိင္းမ်ားႏွင့္ မိသားစုမ်ား၏ ယေန႔ခံစားေနရေသာ နာက်င္မႈမ်ားႏွင့္ ခက္ခဲရုန္းကန္ေနရမႈမ်ားအေပၚ ထပ္တူထပ္မွ်ခံစားရပါေၾကာင္းႏွင့္ ဤသုုိ႔ကၽြႏုု္ပ္တုုိ႔၏ ခံစားခ်က္ကုုိ ေဖာ္ျပရာတြင္ ျငိမ္းခ်မ္းေရး၊ တရားမွ်တမႈႏွင့္ တာဝန္ယူမႈ/တာဝန္ခံမႈကုုိ လိုလားေသာ စိတ္ဓာတ္တို႔သည္လည္း အတူယွဥ္တြဲ ပါဝင္သင့္သည္ဟုု ယံုုၾကည္သည္ႏွင့္အညီ အစိုးရႏွင့္ တပ္မေတာ္အား ကခ်င္ေဒသအတြင္း ျဖစ္ပြားေနေသာ စစ္ပြဲမ်ား အျမန္ဆံုုးရပ္တန္႔ေပးရန္ ကၽြႏ္ုပ္တို႔မွ ေတာင္းဆိုသည္။
