Urgent Appeal to End the Humanitarian Crisis in Kachin State

Mr. President:

Subject: Urgent Appeal to End the Humanitarian Crisis in Kachin State

While we appreciate the efforts the current government is making towards establishing peace in Burma, it has now been one full year since the fighting in Kachin State began. With this letter we, the undersigned civil society and community-based organizations from Burma, urge you to immediately put an end to the humanitarian crisis that is now happening in our homeland.

The previous 17-year ceasefire saw a fragile peace in Kachin State; however, it did not, and has not, resolved any of the root problems between successive governments and the Kachin people. The root problems are the lack of democracy and equality for the ethnic people of Burma. These problems need a political solution and thus a political dialogue yet this has never been afforded to the people of Kachin State. Instead of engaging in a political dialogue the Tatmadaw has mounted a relentless offensive this past year.

Human rights violations committed by Tatmadaw soldiers against civilians living in the conflict area are commonplace and have shown no signs of abating. These human rights violations include, but are not limited to, burned villages, forced displacement, rape, forced labor, torture and killings. These violations have been documented by various organisations since the fighting began. The Kachin Women’s Association of Thailand (KWAT) documented an example in which just last month an ethnic Kachin woman, a 48-year-old mother of twelve, was stabbed, beaten and gang-raped by Tatmadaw soldiers in a church over a period of three days. Fighting has occurred every day and has recently intensified, forcing more and more people to flee their homes. There are around 75,000 people who have become internally displaced persons, living in squalid conditions with nowhere to go and no access to assistance from local or international aid organizations.

It is quite distressing that your orders, Mr. President, for the Tatmadaw to halt offensives have been ignored.

Meanwhile, the state-run media continues to misrepresent the situation by publishing inaccurate information and wrongful accusations that do not reflect the reality of the lives of Kachin people and their calls for equality and self-determination.

With this letter we urge you to immediately end the humanitarian crisis that Kachin people have now been facing for a year by:

  • Taking immediate appropriate actions to end the Tatmadaw’s attacks on Kachin people and to protect civilians.
  • Immediately allowing access to humanitarian aid from both national and international organizations to internally displaced persons.
  • Initiating a meaningful political dialogue with the Kachin Independence Organization and the people of Kachin State in order to achieve sustainable peace and address the issue of equality and democracy for ethnic people.
  • Allowing independent international witnesses and local civil society and community-based organizations to observe peace talks and participate in monitoring mechanisms to ensure compliance with the ceasefire agreement.
  • Stopping the misrepresentation of Kachin people and their desires in state media.
  • Helping the people of Kachin State recover from the physical and mental wounds of war and begin the rebuilding process

အေၾကာင္းအရာ။    ။ကခ်င္ျပည္နယ္တြင္ ျဖစ္ေပၚေနေသာ လူမႈေဘးဒုကၡ (humanitarian crisis) ကို ခ်က္ခ်င္းရပ္တန္႕ေပးရန္ ေတာင္းဆိုျခင္း

ျမန္မာႏိုင္ငံတြင္ ျငိမ္းခ်မ္းေရးတည္ေဆာက္ရန္ လက္ရွိႏိုင္ငံေတာ္အစိုးရ၏ ၾကိဳးစားအားထုတ္မႈအေပၚ အသိအမွတ္ျပဳသည့္ တစ္ခ်ိန္တည္းတြင္ ကခ်င္ျပည္နယ္တြင္ စစ္ပြဲမ်ား ျဖစ္ေပၚေနသည္မွာလည္း တစ္ႏွစ္ တင္းတင္း ျပည့္ျပီျဖစ္ပါသည္။ ထို႕ေၾကာင့္ ေအာက္တြင္လက္မွတ္ေရးထိုးထားေသာ မိမိတို႕ လူထုအေျချပဳ အဖြဲ႕အစည္းမ်ားႏွင့္ အရပ္ဖက္လူထုအသင္းအဖြဲ႕မ်ားမွ လက္ရွိ မိမိတို႕နယ္ေျမတြင္ ျဖစ္ေပၚေနေသာ လူမႈေဘးဒုကၡ (humanitarian crisis) မ်ားကို အျမန္ဆံုးရပ္တန္႕ေပးရန္ ေတာင္းဆိုလိုက္ပါသည္။

လြန္ခဲ့ေသာ ၁၇ ႏွစ္တာ အပစ္အခတ္ရပ္စဲေရးသည္ ကခ်င္ျပည္နယ္တြင္ ခိုင္မာမႈမရွိပဲပ်က္စီးလြယ္သည့္ ျငိမ္းခ်မ္းေရးကို ေပးေဆာင္ခဲ့ေသာ္လည္း အစိုးရႏွင့္ ကခ်င္ျပည္သူမ်ားအၾကား ျပႆနာမ်ား၏ အရင္းအျမစ္ တစ္ခုကိုမွ် ေျဖရွင္းေပးႏိုင္ျခင္းမရွိခဲ့၊ မရွိေသးေပ။ ထိုျပႆနာအရင္းအျမစ္မွာ ဒီမိုကေရစီႏွင့္ တိုင္းရင္းသား ျပည္သူလူထုအတြက္ တန္းတူညီမွ်မႈ ကင္းမဲ့ေနျခင္းပင္ျဖစ္သည္။ ဤျပႆနာမ်ားအတြက္ ႏိုင္ငံေရးအေျဖ ရွာရန္လိုသည္ႏွင့္ တစ္ဆက္တည္း ႏိုင္ငံေရးေတြ႕ဆံုေဆြးေႏြးမႈ မ်ား ျပဳလုပ္ရန္ လိုအပ္ေနေသာ္လည္း ကခ်င္ျပည္သူမ်ားအတြက္ ျပႆနာမ်ားကို အေျဖရွာရန္ ၾကိဳစားမႈမ်ား လံုးဝမရွိေသးေပ။ ႏိုင္ငံေရးေတြ႕ဆံု ေဆြးေႏြးမႈမ်ား ျပဳလုပ္ရမည့္အစား တပ္မေတာ္သည္ ညွာတာမႈကင္းမဲ့စြာ ထိုးစစ္ဆင္မႈမ်ားကို တိုး၍ပင္ ျပဳလုပ္လာခဲ့သည္။

စစ္ပြဲမ်ားျဖစ္ေပၚေနေသာေဒသမ်ားတြင္ ေနထိုင္ေနေသာ ျပည္သူမ်ားအေပၚ တပ္မေတာ္မွ က်ဴးလြန္ေနေသာ လူ႕အခြင့္အေရးခ်ဳိးေဖာက္မႈမ်ားသည္ သာမန္ကိစၥသဖြယ္ ျဖစ္ေပၚေနျပီး ေလ်ာ့က်သြားမည့္ အရိပ္အေယာင္ လည္း မေတြ႕ရေပ။ ဤလူ႕အခြင့္အေရး ခ်ဳိးေဖာက္မႈမ်ားထဲတြင္ ရြာမ်ားမီးရႈိ႕ျခင္း၊ အိုးအိမ္စြန္႕ခြာထြက္ေျပး ေစျခင္း၊ မုဒိန္းက်င့္ျခင္း၊ အတင္းအဓၶမခိုင္းေစျခင္း၊ ညွဥ္းပန္းႏွိပ္စက္ျခင္းမ်ားႏွင့္ သတ္ျဖတ္မႈမ်ား ပါဝင္သည္။ စစ္ပြဲမ်ား စတင္ျဖစ္ေပၚခဲ့ခ်ိန္မွစ၍ ဤခ်ဳိးေဖာက္မႈမ်ားကို အဖြဲ႕အစည္းအသီးသီးမွ မွတ္တမ္းတင္ထားခဲ့ ၾကသည္။ ကခ်င္အမ်ဳိးသမီးအဖြဲ႕ (ထိုင္းႏိုင္ငံ) မွ မွတ္တမ္းတင္ထားေသာ ဥပမာျဖစ္ရပ္တစ္ခုမွာ ျပီးခဲ့ေသာလ အတြင္းတြင္ အသက္ ၄၈ ႏွစ္အရြယ္ ကေလး ၁၂ ေယာက္မိခင္ ကခ်င္တိုင္းရင္းသူတစ္ဦး ကို ျမန္မာ့တပ္မေတာ္ သားမ်ားမွ တရုတ္ျပည္နယ္စပ္အနီး ပန္ဝါျမိဳ႕ရွိ ခရစ္ယာန္ဘုရားရွိခိုးေက်ာင္းအတြင္းတြင္ ဓါးျဖင့္ထိုးျပီး ရိုက္ႏွက္ကာ သံုးရက္ၾကာ အုပ္စုလိုက္ မုဒိန္းက်င့္ခဲ့ျခင္းျဖစ္သည္။

စစ္ပြဲမ်ား ေန႕စဥ္ႏွင့္အမွ်ျဖစ္ေပၚေနျပီး လက္တေလာတြင္ ပိုမိုျပင္းထန္လာခဲ့ကာ အိုးအိမ္စြန္႕ခြာထြက္ေျပး ခဲ့ရသူမ်ား ပိုမိုမ်ားျပားလာခဲ့သည္။ လက္ရွိ ျပည္တြင္းဒုကၡသည္ေပါင္း ၇၅၀၀၀ ခန္႕ရွိျပီး သြားစရာေနရာလည္း မရွိ ေဒသတြင္းႏွင့္ႏိုင္ငံတကာအဖြဲ႕အစည္းမ်ားထံမွလည္း အကူအညီမရရွိပဲ အလြန္တရာဆိုးဝါးလွေသာ အေျခအေနတြင္ ေနထိုင္ေနၾကရသည္။

တပ္မေတာ္၏ထိုးစစ္ဆင္မႈမ်ားကို ရပ္တန္႕ရန္ ထုတ္ျပန္ခဲ့ေသာ သမၼတ၏အမိန္႕ လ်စ္လ်ဴရႈခံခဲ့ရျခင္းမွာ အလြန္စိုးရိမ္ဖြယ္ေကာင္း ပါသည္။ ေနျပည္ေတာ္ ရွိ အရာရွိမ်ားအား လူ႕အခြင္အေရးခ်ဳိးေဖာက္မႈမ်ားအေၾကာင္း အသိေပးအေၾကာင္းၾကားေသာအခါတြင္  ထိေရာက္မႈမရွိေသာ လက္ေအာက္ခံ တရားေရးစနစ္က မသိက်ဳိးကၽြံ ျပဳထားသည့္အတြက္ လြတ္လပ္မႈကင္းမဲ့ကာ ခ်ဳိးေဖာက္ခံရသူမ်ားအေနျဖင့္ တရားမွ်တမႈရွာေဖြရန္ အခြင့္ အလမ္း လံုးဝမရွိ ျဖစ္ေနသည္မွာလည္း အလြန္စိုးရိမ္ဖြယ္ေကာင္းလွပါသည္။ ဥပမာျဖစ္ရပ္တစ္ခုမွာ တပ္မေတာ္က ကခ်င္အမ်ဳိးသမီး စြန္လြတ္ရြယ္ဂ်ာ အား ေအာက္တိုဘာလ ၂၈ ရက္ ၂၀၁၁ ခုႏွစ္တြင္ ဖမ္းဆီး ခ်ဳပ္ေႏွာင္ခဲ့ျပီး ထိုအခ်ိန္မွစ၍ ယင္းအမ်ဳိးသမီးေပ်ာက္ဆံုးသြားခဲ့သည့္ အမႈျဖစ္ျပီး ေဖေဖာ္ဝါရီလ ၂၃ ရက္ေန႕ ၂၀၁၂ ခုႏွစ္တြင္ ျပဳလုပ္ေသာ ျပည္ေထာင္စုတရားလႊတ္ေတာ္ခ်ဳပ္ ၾကားနာမႈတြင္ တပ္မေတာ္အာဏာပိုင္မ်ားမွ သူမအားဖမ္းဆီးခ်ဳပ္ေႏွာင္မႈအေပၚ တစ္စံုတရာမသိရွိေၾကာင္း ထြက္ဆိုကာ ျငင္းဆန္ခဲ့ၾကသည္။

ျမန္မာႏိုင္ငံအမ်ဳိးသားလူ႕အခြင့္အေရးေကာ္မရွင္ကလည္း ထိုသို႕ေသာ ခ်ဳိးေဖာက္မႈမ်ဳိးကို အေရးမၾကီးဟု မွတ္ယူထားျပီ ေကာ္မရွင္ဥကၠ႒ ဦးဝင္မရကိုယ္၌က ထိုသို႕ေသာ အမႈကိစၥမ်ားအားစံုစမ္းစစ္ေဆးရန္ ”လက္ရွိအခ်ိန္တြင္မသင့္ေတာ္” ဟု သတင္းေထာက္မ်ားအား ေျပာၾကားခဲ့သည္။
လတ္တေလာတြင္ အစိုးရသတင္းစာမ်ားက တိက်မႈမရွိေသာသတင္းမ်ားႏွင့္ ကခ်င္ျပည္သူမ်ား၏ လက္ေတြ႕ ဘဝႏွင့္ ၎တို႕ေတာင္းဆိုေနေသာ တန္းတူညီမွ်မႈရွိေရးႏွင့္ ကိုယ္ပိုင္ျပ႒န္းခြင့္တို႕အေပၚ ထင္ဟပ္မႈမရွိေသာ မွားယြင္းသည့္စြပ္စြဲခ်က္မ်ား ထုတ္ျပန္ျပီး အေျခအေနမွန္ကို မွားယြင္းစြာေဖၚျပေနမႈမ်ား ဆက္လက္ျပဳလုပ္ေနဆဲ ျဖစ္သည္။

ထို႕ေၾကာင့္ သမၼတအေနျဖင့္ ေအာက္ပါအခ်က္မ်ားကို အေကာင္အထည္ေဖာ္ျခင္းအားျဖင့္ ကခ်င္ျပည္သူမ်ား တစ္ႏွစ္ျပည့္သည့္တိုင္ ဆက္လက္ရင္ဆိုင္ေနရေသာ လူမႈေဘးဒုကၡ (humanitarian crisis) မ်ားကို ခ်က္ခ်င္း ရပ္တန္႕ရန္ မိမိတို႕က ဤစာျဖင့္ ေတာင္းဆိုလိုက္ပါသည္။

  • တပ္မေတာ္က ကခ်င္ျပည္သူမ်ားအားတိုက္ခိုက္ေနမႈမ်ားကို ရပ္တန္႕ေပးရန္ႏွင့္ ျပည္သူမ်ားကို အကာအကြယ္ေပးရန္ သင့္ေတာ္ေသာ လုပ္ေဆာင္မႈမ်ားကို ခ်က္ခ်င္းအေကာင္အထည္ေဖာ္ရန္
  •  ျပည္တြင္းႏွင့္ ႏိုင္ငံတကာအဖြဲ႕အစည္းမ်ား၏ လူသားခ်င္းစာနာေထာက္ထားေသာ အကူအညီမ်ား ျပည္တြင္းဒုကၡသည္မ်ား ထံသို႕ေပးပို႕ျခင္းကို ခြင့္ျပဳရန္
  • တိုင္းရင္းသားျပည္သူမ်ားအတြက္ ခိုင္မာေသာျငိမ္းခ်မ္းေရးရရွိေရးႏွင့္ ဒီမိုကေရစီႏွင့္တန္းတူညီမွ်ေရး ကို ေျဖရွင္းေပးႏိုင္ရန္ ကခ်င္ျပည္လြတ္ေျမာက္ေရးအဖြဲ႕ (KIO) ႏွင့္ ကခ်င္ျပည္သူမ်ားႏွင့္ အႏွစ္သာရျပည့္ဝေသာ ႏိုင္ငံေရးေတြ႕ဆံုေဆြးေႏြးမႈမ်ား စတင္ရန္
  • အပစ္အခတ္ရပ္စဲေရးသေဘာတူညီခ်က္မ်ားကို အဖြဲ႕အားလံုးမွလုိက္နာေအာင္ အာမခံခ်က္ေပးႏိုင္ရန္ ႏိုင္ငံတကာမွ လြတ္လပ္ေသာ သက္ေသမ်ား၊ ေဒသခံလူထုအေျချပဳအဖြဲ႕အစည္းမ်ားႏွင့္ အရက္ဖက္လူထုအသင္းအဖြဲ႕မ်ားကို ျငိမ္းခ်မ္းေရးေဆြးေႏြးပြဲ မ်ားအား ေစာင့္ၾကည့္ေလ့လာခြင့္ေပးရန္ ႏွင့္ အပစ္အခတ္ရပ္စဲေရး ေစာင့္ၾကည့္မႈ ယႏၵယားမ်ားတြင္ ပါဝင္ခြင့္ေပးရန္
  • အစိုးရပိုင္သတင္းစာမ်ားတြင္ ကခ်င္ျပည္သူမ်ားႏွင့္ ၎တို႕၏ဆႏၵမ်ားအေပၚ မွားယြင္းစြာေဖာ္ျပေနမႈ မ်ားကို ရပ္တန္႕ရန္
  • ကခ်င္ျပည္သူမ်ားကို စစ္မက္ေၾကာင့္ခံစားေနရေသာ စိတ္ပိုင္းဆိုင္ရာႏွင့္ရုပ္ပိုင္းဆိုင္ရာ ထိခိုက္မႈမ်ားမွ ျပန္လည္ေကာင္းမြန္လာေအာင္ ဝိုင္းဝန္းကူညီရန္ႏွင့္ ျပန္လည္ထူေထာင္ေရးလုပ္ငန္းစဥ္ကို ကခ်င္ျပည္လြတ္ေျမာက္ေရးအဖြဲ႕ (KIO) ႏွင့္ ကခ်င္လူထုအေျချပဳအဖြဲ႕အစည္း မ်ားႏွင့္အတူ စတင္ ပူးေပါင္းလုပ္ေဆာင္ရန္
